the legality is based upon common law in that penalty fees for default of a contract are illegal, the person who defaults (ie me going over my overdraft limit) will have to pay to rectify the damage caused to the other party by my default, however this is to repair the damage i have caused them not to give them a bonus prize for my defaulting. The actual cost to a bank for a bounced cheque etc is estimated to be about £4.50 not the £35 they charge. I would check this out as contract law does not differ too much from country to country
