Last week while flipping through a WSJ, there was a full page add by some astroturf group formed by Tillinghast-Towers Perrin discussing how much medical lawsuits cost you, and how dire it is we change it. Totally hilarious, like we've covered before here at rs.n, that's the reason we have health insurers - so it doesn't cost me.

I don't think it's a matter of hope... unless you mean "hope the judge loses". In a civil trial, if the prosecution fails, then then they are liable for the defendant's court costs. Which seems like a reasonable way to guard against pointless litigation.

Its still sad that these folks have lost over two years of their lives over a pants dispute. Court cost liability does not justify or erase the loss of over 2 years of harassment and frivolous expenses.
I don't know how yet, but I would argue that the system should work better than that.

If there is a vociferous and rabid prosecutor after your ass for over two years, a future promise of a big cash settlement won't help you pay for the fees of representation in the present. That would be on you.

So what sort of Big Goverment solution would work here, seeing as the free market is failing so miserably (risk of losing the case and penalty versus need to seek redress and windfall decision)?
