I think the Supreme Court is a scare tactic. The Court exists to rubber stamp agreed upon social changes, it's not an activist for change. Roe v. Wade is 30 years in the bag, and supported by a majority of Americans, it's safe.
Remember Bush 41 trying to pack the court? We got Thomas, true. But also that nut Souter. The Court walks the line, sometimes it strays left, sometimes it strays right. It struck down anti-sodomy laws in 2003, not very activist in my opinion.
Everyone agrees that the most far-reaching Court opinion of the last decade was Walker vs. .., ok, forgetting it right now. About the constitutionality of laws requiring minimum sentences. Scalia and Stevens wrote the majority opinion.
